On Friday, March 22, 2024, the Bundesrat will decide on the enactment of the upcoming cannabis law. The Bundestag has already voted in favor of the CanG with an absolute majority, but the law can only come into force once the Bundesrat gives its approval. This follows the usual process in Germany before the passing of a law. However, some federal states have already spoken out against the law and are trying to prevent it from coming into force as planned on April 1, 2024. However, it is certain that the law will ultimately come into force. The current question is only when this will happen.

The Mediation Committee

The Mediation Committee plays a crucial role in this. Some states want the Bundesrat to call the Mediation Committee, which would result in a delay of the law. For this to happen, at least 35 states need to vote for the call of the committee. Currently, there are 30 abstentions, which means that these countries do not vote for the Mediation Committee, and 14 more states are leaning towards abstention. On the other hand, 21 states are voting for the call of the Mediation Committee, while another four states are tentatively in favor of calling the committee.

So far, everything indicates that the mediation committee will not be called and the law will come into force as planned on April 1, 2024.
