On 23 February 2024, the Bundestag voted with a clear majority for the implementation of the draft law, which regulates a controlled handling of cannabis in Germany. This historic decision paves the way for the decriminalization of cannabis from 1 April 2024 and opens the doors for hobby growers in cannabis clubs from 1 July 2024. A reason to celebrate and rejoice for all supporters and all those who have been fighting for justice for years.

Is the CanG. being delayed after all?

But the joy was short-lived, as additional obstacles are being put in the way of the law's implementation. The whole venture could be delayed due to a possible mediation procedure. Despite an absolute majority for the CanG in the Bundestag, the Bundesrat could call the mediation committee and object, especially due to the feared additional burden on the criminal justice system regarding amnesty provisions.

Final clarity about the timetable is only expected after the Bundesrat's meeting on 22 March. Despite the current uncertainty, there is reason for optimism. The law is likely not to be stopped, only the timing of the implementation could be pushed back further.
